1. Agreement to Terms
By accessing or using YouTubeGen ("Service") operated by Spody Ai LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
YouTubeGen is an AI-powered platform that generates YouTube thumbnails using artificial intelligence. The Service includes: • AI-generated thumbnail creation from text prompts • Reference image-based generation • Character/face integration features • AI chat assistant for creative ideas • Gallery storage for generated images
3. Account Registration
• You must provide accurate and complete information when creating an account • You are responsible for maintaining the security of your account credentials • You must be at least 16 years old to use the Service • One person may not maintain multiple free accounts
4. Subscriptions and Payments
Credit System: • The Service uses a credit-based system ("Sparks") • Credits are consumed when generating thumbnails (80 sparks per generation) • New accounts receive 240 free sparks to try the Service Subscriptions: • Paid plans are billed monthly and renew automatically • Each subscription tier includes a monthly allocation of sparks • Unused sparks do not roll over to the next billing period • You can cancel your subscription at any time from your profile • Upon cancellation, you retain access until the end of the billing period Payments: • Payments are processed securely by Paddle as our Merchant of Record • All prices are displayed in the currency shown at checkout • We reserve the right to modify pricing with 30 days notice
5. Acceptable Use
You agree NOT to use the Service to: • Generate illegal, harmful, or offensive content • Create content that infringes on intellectual property rights • Generate misleading or deceptive content (deepfakes intended to deceive) • Produce adult/NSFW content • Harass, abuse, or harm others • Violate any applicable laws or regulations • Attempt to bypass usage limits or security measures • Resell or redistribute the Service without authorization Violation of these terms may result in immediate account termination without refund.
6. Intellectual Property
Your Content: You retain ownership of any content you upload to the Service. By uploading, you grant us a limited license to process your content for the purpose of providing the Service. Generated Content: • You own the thumbnails generated through your use of the Service • You may use generated content for commercial and personal purposes • We do not claim ownership of your generated content • We may use anonymized data to improve our AI models Our Intellectual Property: The Service, including its design, features, and underlying technology, is owned by Spody Ai LLC and protected by intellectual property laws.
7. AI-Generated Content Disclaimer
⚠️ Important: Our Service uses AI technology that may occasionally produce unexpected or imperfect results. You are responsible for reviewing and ensuring that generated content is appropriate for your intended use. We do not guarantee that generated content will be free from errors, biases, or inappropriate elements.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPODY AI LLC SHALL NOT BE LIABLE FOR: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, data, or business opportunities • Any damages arising from your use of AI-generated content • Service interruptions or technical failures Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Termination
• You may terminate your account at any time by contacting support • We may suspend or terminate accounts that violate these Terms • Upon termination, your right to use the Service ceases immediately • We may retain certain data as required by law
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Georgia. Any disputes shall be resolved in the courts of Tbilisi, Georgia.
